Agreement to Terms
By accessing or using Remember When ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
Description of Service
Remember When is a private family memories platform that allows users to upload, store, and share photos and videos with family members. The Service includes features such as photo and video storage, family trees, milestone tracking, albums, and activity feeds.
Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access to your account
- Be responsible for all activities under your account
You must be at least 18 years old to create an account. Parents or guardians may create accounts and upload content on behalf of their children.
User Content
Your Content
You retain ownership of all content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited license to store, display, and transmit your content solely for the purpose of providing the Service to you and your family members.
Content Guidelines
You agree not to upload content that:
- Violates any applicable laws or regulations
- Infringes on the intellectual property rights of others
- Contains malware, viruses, or harmful code
- Is obscene, defamatory, or promotes violence
- Depicts illegal activities or exploitation of minors
Subscription and Payments
Free and Premium Plans
The Service offers both free and premium subscription plans. Premium features include additional storage, longer video uploads, and advanced features as described on our pricing page.
Billing
Premium subscriptions are billed monthly. You authorize us to charge your payment method on a recurring basis until you cancel. All payments are processed securely through Stripe.
Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. After that, your account will revert to the free plan.
Refunds
We offer a 30-day money-back guarantee for new premium subscriptions. Contact us within 30 days of your first payment for a full refund. Subsequent billing periods are non-refundable.
Storage Limits
Each plan includes specific storage limits as described on our pricing page. If you exceed your storage limit, you may need to upgrade to a higher plan or remove content to continue uploading.
Family Sharing
The account owner ("Family Admin") can invite family members to join their family account. The Family Admin is responsible for managing family members and billing. All family members share the account's storage and subscription status.
Intellectual Property
The Service, including its design, features, and content (excluding User Content), is owned by Remember When and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.
Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. While we take reasonable measures to protect your data, we cannot guarantee absolute security.
Limitation of Liability
To the maximum extent permitted by law, Remember When shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of the Service.
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may also delete your account at any time. Upon termination, your content will be deleted within 30 days, except where retention is required by law.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
